Terms & Conditions
· BOOKINGS & PAYMENT : Due to strictly limited class sizes - classes must be booked and paid for one week in advance. In the event that you are unable to make your booked class you may change (with a minimum of 48 hrs notice) to an alternative class in the same week [subject to availability]. In the event that notice is given less than 48 hrs before your scheduled class or no notice at all – your fee for that week will be forfeited.
· SAFETY : Students must adhere to all safety guidelines posted in the studio and all verbal instruction regarding the use of various materials and tools. Do not operate any electrical tools (hairdryer etc) with wet hands. Please keep water pots well away from any electrical appliances / outlets in the studio.
· CLEANLINESS: Please ensure all paint, water and drink spillages are cleaned up immediately. All tools provided by the studio MUST be washed and left to dry in the sink area at the end of each session. Please be aware of paint on your hands and avoid leaving marks in or around the studio. At the end of each session please clean your work area and return all materials and tools to the storage cupboard. Do not leave brushes saturated in paint for any length of time while you are painting as the paint dries and ruins the brush (in the event that you fail to clean a brush properly consequently ruining the brush – you will be liable to replace the brush.)
· COPYRIGHT : Samples of various artists’ works are available for learning references – any works representing any artist’s original composition may not be sold if it may be deemed a breach of the original artist’s copyright.
· CLASSES INCLUDING MATERIALS : These classes include the use of all polymer/acrylic and ink mediums; texturing mediums; tools & brushes; varnish and stretched canvas. All other varnishes (shellac and glass coat) will attract an additional minimum charge of at least $10 per piece depending on the coverage area.
· SALE of ARTWORK : Any original artworks by students are able to be sold through the studio website/exhibitions. Any sales through the studio will attract a 30% commission to cover administrative costs.
· PARKING : Please ensure that you park courteously when attending the studio.
· SMOKING/EATING/DRINKING: The studio has a ‘no smoking policy’ in line with current legislation – this means you may only smoke 4 metres from any entrance. No foods may be consumed in the studio. Drinks may be consumed but please ensure that any spillage is cleaned immediately.
· PHOTOGRAPHS : As part of the studio’s marketing, images may be taken of you and/or your artwork for promotional use. By initialling this clause you agree to have your image published in various media accompanied by your first name.
· DISCLAIMER: Students participating in or undertaking classes with Sebastian Studios expressly acknowledge that in the course of undertaking classes use is made of paints, inks, solvents, chemicals, art tools, art utensils and other materials which are dangerous and the classes are undertaken and these materials are used at the students' own risk.
Sebastian Studios, to the extent permitted by law, expressly disclaims liability to students for:a) Any injury to a student or loss to a student's property however occurring before, during or after classes whilst that student is on these premises;
b) any negligent acts or omissions of Sebastian Studios, its instructors, servants, agents or licencees occurring before, during or after classes whilst a student is on these premises;
c) any breach of contractual duty or obligation owed by Sebastian Studios to any students in relation to personal safety before, during or after classes whilst the students are on these premises;
d) breach of any duty owed by Sebastian Studios to any students as an occupier of these premises;
e) breach of any statutory duty which Sebastian Studios its directors, instructors, employees, servants or agents may owe to students;
f) any other liability howsoever caused or arising as a result of the undertaking of the classes or the entry into these premises by any students.
The lessee of these premises, Discount Art Warehouse as trustee for the Hutchinson Discretionary Trust No 5 and Credo Pty Ltd as trustee for the Credo Trust No 5, together with their servants, agents and contractors to the extent permitted by law, expressly disclaim any liability for:
a) any injury arising to students caused by these premises or any part of these premises being unsafe or in any way defective;
b) any other personal loss or property damage of any students arising by virtue of these premises being unsafe or defective in any manner;
c) any personal injury, personal loss or property damage to any other person who may accompany a student upon these premises arising as a result of these premises being unsafe or in any way defective;
d) any negligent acts or omissions on their part in maintaining these premises which causes loss or damage to any student;
e) any breach of statutory duty owed to users of these premises which causes loss or damage to any student.
Students and any persons accompanying them enter and remain on these premises at their own risk and of their own free will.
